General Terms and Conditions

1. SCOPE OF APPLICATION

For all orders placed through our store on Amazon Marketplace and our website www.loouma.com which directs you to Amazon Marketplace when purchasing your product, the following terms and conditions apply.

2. CONTRACTING PARTIES, CONCLUSION OF CONTRACT, CORRECTION OPTIONS

The purchase contract is concluded with GoMambo OÜ.

The presentation of the products in the online store is not a legally binding offer, but a non-binding online catalog. You have the option to complete the ordering process via the shopping cart system or the 1-Click/ Buy Now function.
You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained for this purpose in the order process. By clicking the order button, you submit a binding offer for the goods contained in the shopping cart.
When ordering via the 1-Click / Buy Now function, you place your order without detour via the shopping cart. By pressing the button “Buy now with 1-Click” or “Buy now”, an order is automatically created, which is sent to the delivery address you have provided and for which payment is made with the specified payment method. You can check if your shipping and payment information is correct in the pop-up window. You can check and change your 1-Click/ Buy Now settings at www.amazon.de/gp/css/account/address/view.html.
You also have the possibility to change or cancel your orders within 30 minutes.
Confirmation of receipt of your order will be sent by e-mail immediately after you submit your order. We will accept your order within 2 days by.

* we or Amazon on our behalf submit/deliver a declaration of acceptance or shipping confirmation in a separate email or
* we or Amazon on our behalf deliver the goods / let or
* if applicable, the payment transaction is carried out by the service provider or the selected payment service provider. The time of execution of the payment transaction depends on the respective selected payment method (see under “Payment”).

The relevant alternative for you depends on which of the listed events occurs first.

3. CONTRACT LANGUAGE, CONTRACT TEXT STORAGE

The language(s) available for the conclusion of the contract: German, English.

We store the contract text on our systems, which, however, are not accessible to you. However, you have the possibility to view your last orders via your Amazon account. The complete contract text is not accessible there.

4. PAYMENT

The payment processing is carried out by Amazon. You can pay the invoice amount by credit card or direct debit. On the Amazon.de domain, Amazon additionally offers the payment methods monthly invoice, financing, iDeal, Przelewy24, BLIK and Bancontact for Marketplace items (items that are not sold by Amazon.de) and items with the note “shipping by Amazon”. For the payment methods credit card, direct debit, monthly invoice (in cooperation with arvato Payments Solutions GmbH), financing (in cooperation with Barclays Bank Ireland PLC Hamburg Branch (“Barclaycard”)) the payment is made after shipment of the goods. For the payment methods iDeal, Przelewy24, BLIK and Bancontact, the debit takes place immediately after completion of the order. The payment methods monthly invoice and financing require a successful address and credit check. For financing, a one-time registration with Barclaycard is also required. For the payment method iDEAL you need a Dutch, for Bancontact a Belgian and for Przelewy24/BLIK a Polish bank account.
Amazon forwards the payment to us without receiving your payment details. 5. OUR VOLUNTARY RETURN GUARANTEE

Without prejudice to your statutory rights, we offer you the following voluntary return guarantee:
You may return many products you purchase from us within 30 days of receipt of the goods. 6. RESERVATION OF OWNERSHIP

The goods remain our property until full payment has been received.

7. WARRANTY AND GUARANTEES

The statutory liability for defects applies. Information on any applicable additional warranties and their exact conditions can be found with the product and on special information pages in the online store.

8. LIABILITY

For claims based on damages caused by us, our legal representatives or agents, we are always liable without limitation
– in case of injury to life, body or health
– in case of intentional or grossly negligent breach of duty
– in the case of warranty promises, insofar as agreed, or
– insofar as the scope of application of the Product Liability Act is opened.
In the event of a breach of essential contractual obligations, the fulfillment of which is a prerequisite for the proper execution of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations) due to slight negligence on our part, on the part of our legal representatives or vicarious agents, liability shall be limited to the amount of the damage foreseeable at the time of the conclusion of the contract, the occurrence of which must typically be expected.
Otherwise, claims for damages are excluded.

 

9. DISPUTE RESOLUTION

The European Commission provides a platform for online dispute resolution (OS), which you can find here: ec.europa.eu/consumers/odr/. We are not obliged or willing to participate in a dispute resolution procedure before a consumer arbitration board.

10. PROTECTION OF MINORS

If your order includes goods, the sale of which is subject to age restrictions, we ensure through the use of a reliable procedure involving a personal identity and age check that the customer has reached the required minimum age. The delivery person hands over the goods only after the age check has been carried out and only to the orderer personally.
